Florida lawsuit aims to save tennis grounds in private community

A tennis association in the Grove Isle section of Miami is suing the developers of a proposed luxury condominium project, contending that construction of the complex would mean current residents would lose some tennis amenities.

The condominium has been in the works on the private island for more than five years. There already are three residential towers, and owners of units in the buildings enjoy tennis and other privileges.

Construction of the new units, however, will take away eight tennis courts, according to the association's lawsuit. It also has named as defendants three other groups, including the condominium owners association, arguing they are in violation of a permanent injunction that demands the developer to make available a pool, tiki bar and at least eight tennis courts during construction.

"There is no need to violate the permanent injunction in the way that has been threatened," the lawsuit reads.

The developer already is facing a lawsuit from a nonprofit organization that has said the design of the project would put existing residences in peril because the new construction could make the wind worse during hurricanes and tropical storms. The "Save Grove Isle" lawsuit, as it is known, was described by the developer as merely an effort to delay construction.

Property owners have a right to enjoy their property and to seek legal relief if a proposed project could have a negative impact on property values or use of the property. It will be up to the courts to determine whether lawsuits are an attempt to keep future development off Grove Isle or if the cases have merit and should continue.
