Construction Litigation

Tips to select a lawyer for construction litigation

If you have never been involved in litigation, then you may not know the best way to go about hiring a competent attorney who is experienced in your particular issues. You likely see numerous T.V., bus, and billboard ads for a variety of attorneys who promise you’ll pay “cents on the dollar” or open with “if you were injured in a car accident.” While those attorneys are experienced in personal injury and tax litigation, how does that help you through your construction dispute?

The Florida Bar, at the behest of the Supreme Court of Florida, offers a “Board Certification” to certain attorneys. The program is designed to ensure that members of the public can become identity lawyers who are experienced in their particular issue so you don’t waste valuable time searching for the right attorney.

Although it is not required to practice construction litigation, Florida does allow attorneys to specialize in construction law by obtaining a “Board Certification in Construction.” Lawyers who receive this commendation are knowledgeable in areas relating to the design and construction of improvements and legal techniques associated with construction disputes. For instance, these lawyers should be experienced in construction dispute resolution, contract negotiation, preparation, government affairs, document review, scheduling analysis, delay claims, insurance, licensing, and other areas.

You don’t need to hire a board-certified attorney to resolve your construction dispute. But, if your claim is particularly complicated, it is sometimes a good idea to fall back on that expertise. A lawyer experienced in construction matters can quickly identify risks to your company and assist you in resolving them.
